Ms Cross was terminated from Oz Sale Pty Ltd on 5 July 2008; she lodged an application for unlawful dismissal on 1 August 2008, five days out of the statutory time period. Oz Sale Pty Ltd objected on the basis that Ms Cross’ application was lodged out of time. The matter therefore went to a hearing to decide whether or not an extension of time would be granted. Ms Cross was represented by AWNA in this hearing.
On 27 November 2008 Commissioner Roberts handed down a decision, allowing the extension of time and referring the application to conciliation.
