Seeking Support for a Toxic Workplace in Australia?

A toxic workplace can severely impact your mental and physical well-being, job satisfaction, and career progression. In Australia, employees have rights and protections against harmful workplace behaviours. If you are experiencing a toxic work environment, our representatives are here to provide expert guidance and support to navigate these challenging situations.

What is a Toxic Workplace?

A toxic workplace is generally characterised by a negative and dysfunctional environment, often lacking trust and respect. While not always unlawful, certain toxic behaviours can constitute workplace bullying, harassment, or discrimination, which are serious breaches of Australian workplace laws.

Is Your Workplace Toxic?

Ask yourself:

  • Does your workplace have a high turnover rate?
  • Is absenteeism common among staff?
  • Are morale, productivity, and performance consistently low?

Do you notice any of these behaviours from your boss or colleagues?

  • Blaming others for their mistakes
  • Raising false concerns or unfair criticism
  • Making unreasonable demands
  • Yelling, screaming, or threatening job loss
  • Enforcing inconsistent or arbitrary rules
  • Social exclusion or isolation
  • Taking credit for others’ work

If you’ve answered yes to any of these, you may be in a toxic work environment.

What You Can Do If You’re Being Bullied or Harassed?

No one should suffer in silence. While it's important to report workplace bullying and harassment to senior management, here are steps you can take to protect your wellbeing and assert your rights:
1. Stay Composed
Don’t respond to aggression with aggression. Yelling back may escalate the situation and could be used against you later if you pursue a formal complaint.
2. Set Boundaries with Confidence
If you’re being constantly criticised or belittled, use calm and firm communication to call out the behaviour. Protect your self-esteem by refusing to internalise it.
3. Talk to Someone
Reach out to someone outside of work—a trusted friend, family member, or professional. Don’t bottle it up.
4. Keep a Record
Document every incident: dates, times, what happened, and any witnesses. This can be vital if the issue escalates.
5. Seek Internal Support
Raise your concerns with HR, your manager, or a trusted leader. They are obligated to take your complaint seriously and act on it.
6. Get Professional Advice
Speak with a workplace representative who specialises in bullying and harassment. We offer expert, understanding support if you need it.
7. Consider Medical Support
If your mental or physical health is affected, talk to a doctor or counsellor. They can support you emotionally and assist with WorkCover documentation, if needed.
8. Explore Your Options
Workplace bullying claims can be complex. If your case meets certain criteria, you may be able to lodge a WorkCover claim—though these can be hard to get approved without medical backing.

We assist with lodging General Protections Claims for those affected by sexual harassment or workplace bullying, whether you've been dismissed (F8 Application) or are still employed and facing adverse action (F8C Application).

F8 Application: For post-dismissal claims. Must be filed within 21 days.
F8C Application: For ongoing adverse actions, such as warnings or suspensions.

We also support you through the conciliation conference, where we aim to resolve your matter quickly and fairly.

Missed the deadline? You may still have options through State and Territory anti-discrimination commissions.

Frequently Asked Questions About Toxic Workplaces

A toxic workplace is often marked by ongoing negativity—such as low morale, constant gossip, lack of leadership support, or feeling undervalued or anxious on a regular basis. These issues tend to persist over time and affect both individual wellbeing and team dynamics.

Not always. Short-term stress can be a normal part of busy periods or tight deadlines. However, if stress stems from ongoing issues like bullying, manipulation, exclusion, or conflict, it may indicate a deeper problem with the workplace culture.

Begin by documenting any concerning behaviour—include dates, times, what occurred, and who was involved. Where appropriate, raise your concerns with a trusted manager or HR representative. If the situation doesn't improve or becomes more serious, seeking advice from an employment lawyer can help you understand your rights and possible next steps.

No. Under the Fair Work Act 2009, it is unlawful for an employer to take adverse action—such as dismissal or demotion—against an employee for raising concerns or making a complaint in good faith. These protections fall under the General Protections provisions of the Act.

You have the right to work in an environment that is safe, respectful, and free from bullying, harassment, or discrimination. If these standards are not being met, you may be able to raise the matter through internal processes or seek external support.

Maintain detailed records of concerning incidents, keep communications respectful and professional, and set clear boundaries. Where possible, minimise interactions with individuals contributing to the negative environment. Accessing support from a counsellor, GP, or mental health professional can also help you manage the personal impact.
