Terminated After Taking Leave: Bain v Terrock Pty Ltd [2007] AIRC 604

Ms Bain was an employee of Terrock from 7 November 2000 until 4 June 2007. Ms Bain alleged that she had been terminated after being absent from work due to illness and because of her age. Ms Bain filed an application with the Commission 3 days out of time. The Respondent immediately filed a jurisdictional objection, stating that Ms Bain’s application should be dismissed due to being out of time.

On 26 July 2007 Commissioner Gooley handed down a decision allowing an extension of time for Ms Bain’s application.
