Ms Gooch commenced employment with Proware Pty Ltd in June 2008, she was dismissed on 29 March 2012. The matter did not settle at conciliation, and Ms Gooch elected to pursue the claim to an arbitration hearing. Proware then filed a jurisdictional objection against the application, stating that the application was made on a ‘frivolous or vexatious’ basis.
AWNA represented Ms Gooch in the hearing for the jurisdictional objection, which resulted in the objection being dismissed.
The matter was then heard on 12 November 2012 before Commissioner Cargill; Ms Gooch was represented by AWNA.
On 20 December 2012 Commissioner Cargill handed down a decision stating that Ms Gooch’s dismissal was harsh, unjust, or unfair, and ordered that Proware make payment of $8,653.86 as compensation for loss of income.
