Ms Ruck commenced her employment with API in 2000; she resigned on 6 July 2006. API filed a jurisdictional objection to Ms Ruck’s claim, stating that as she had resigned, her application should be dismissed.
On 21 August 2006 Senior Deputy President Watson handed down a decision, stating that Ms Ruck had been forced to resign, and therefore, termination was at the initiative of API.
